PDL’s Non-Proprietor Pharmacist Liabilities Insurance Master Policy

PDL’s Non-Proprietor Pharmacist Liabilities  Insurance Master Policy (PDL Master Policy) is underwritten by Guild Insurance Limited. All active members of PDL are afforded cover under this policy subject to the policy’s terms and conditions and any individual conditions that the underwriter places on an individual member’s cover. 

The cover provided by the PDL Master Policy is on a claims made basis meaning that you will be covered for claims first made against you during the period of cover regardless of when the incident that gave rise to the claim occurred, subject to the retroactive date and excluding known circumstances – please refer to the policy wording for full details.

COVID-19 vaccination program and your PDL Non-Proprietor Pharmacists Liabilities Insurance Master Policy 

We understand that as part of the vaccine rollout, many of our members have already been or will soon be told whether they are able to participate in the COVID-19 vaccination program. The roll out of the program has many moving parts, and now is a great time to consider your insurance needs if you will participate in this program.

Confirming your current cover

You can be certain that if you are participating, your PDL Master policy covers you for the administration of the COVID-19 vaccination from the moment you see your first patient. You will need to ensure that you understand and comply with the obligations that are placed on you by government approved protocols and training.

Your premium will not change as a result of your participation in the vaccination program.

Changes to your PDL cover

While your current PDL cover protects you for your participation, from 30 April 2021, there will be some changes made to the PDL Master policy upon renewal:

Vaccine cover

The PDL Master policy will have a new vaccine cover specifically added. This will clarify the cover you have for the administration of the COVID-19 vaccinations (and other vaccinations also) as long as you take reasonable steps to understand and comply with the obligations that are placed on you by government approved protocols and training.

Vaccine efficacy

In Australia the general legal position is that issues regarding the efficacy of a product or whether a product is fit for purpose are the responsibility of the manufacturer. As such, any patient seeking compensation for harm caused by a COVID-19 vaccine should pursue the relevant manufacturer. Consequently, we have clarified that the policy does not cover claims connected with the efficacy of vaccines and therefore reduced the likelihood of you being pursued for compensation that is the responsibility of vaccine manufacturers.

Efficacy defence cost cover

Efficacy Defence Costs cover is a new and unique peace of mind benefit. It is designed to protect you from speculative actions by third parties attempting to wrongly draw you in to a claim that should properly be pursued against the vaccine manufacturers. This is a benefit that is exclusively available to pharmacists from PDL and Guild Insurance, and it will not have an impact on your premium.

While vaccine efficacy cover will be excluded, we are providing this new cover for legal defence costs incurred on your behalf of up to $250,000 to defend you if you are named as a defendant in a claim where the cause of patient harm is deemed to be the vaccine, rather than its preparation or administration by you as a pharmacist.
